Truck drivers for two delivery firms won summary judgment in a wage suit after a federal court determined they’re employees under Illinois law, not independent contractors.
The drivers had accused DVL Express Inc. and Altex Logistics Inc. of misclassifying them as contractors, depriving them of employee protections such as business expense reimbursements. The Illinois Wage Payment and Collection Act clearly makes the drivers employees, despite agreements describing them as independent contractors, the US District Court for the Northern District of Illinois said.
