Debtor’s FDCPA Suit Over Confusing Direction to Website Advances

Written encouragement to use a debt collector’s website could have confused borrowers on how to dispute their debts in violation of the the Fair Debt Collection Practices Act.

Brenda Winter received a written notice from Debtsy Inc in August 2021 in an attempt to collect a $655 debt on behalf of Crown Asset Management. Under the FDCPA, debtors may dispute letters in writing, but Winter told the US District Court for the Southern District of Illinois that Debtsy’s notice wasn’t clear whether using the company’s website—as the letter encouraged her to do—qualified.
