Darden Restaurants Wins Dismissal in Advocacy Group’s Wage Suit

Darden Restaurants Inc. has won another round in a lawsuit alleging that its cash wage and tipping policies encourage sexual harassment and racially disparate wages.

Judge Edward M. Chen of the US District Court for the Northern District of California on Tuesday dismissed the second amended complaint the nonprofit advocacy organization One Fair Wage Inc. filed against the operator of restaurants including Olive Garden, LongHorn Steakhouse, and the Capital Grille. OFW advocates for the elimination of submininum wages for tipped workers.

The court gave the group three weeks to file a motion to reconsider the ruling.
