CVS Worker Sex Bias Suit Outside Arbitration Opt-Out Law’s Reach

CVS Health Corp. units won their bid to shift a former store manager’s sex discrimination lawsuit to arbitration because the claims didn’t fall under a new arbitration opt-out law.

The ruling Wednesday by the US District Court for District New Jersey is the latest to address the scope of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act. The March 2022 law allows workers otherwise bound by employment arbitration agreements to pursue their case in court if the dispute relates to sexual harassment or sexual assault.
