CVS Pharmacy Worker’s Pregnancy Bias Claims Sent to Arbitration

A CVS Pharmacy employee’s disability discrimination claims against the company will move to arbitration after a Maryland district court said the arbitration agreement she signed during on-boarding is valid.

Michelle Wooten sued Maryland CVS Pharmacy LLC for allegedly failing to grant her a timely accommodation for her high-risk pregnancy that required her to sit down at work. She also alleges the company retaliated by placing her on a temporary suspension. She asserted claims for disability discrimination, harassment, and retaliation under the Americans with Disabilities Act and the Maryland Fair Employment Practices Act.
