CVS, Catholic Nurse Head to Jury Trial Over Contraceptive Policy

A jury must decide whether CVS Health Corp. and two subsidiaries failed to accommodate and unlawfully fired a Roman Catholic nurse practitioner who refused to dispense hormonal contraceptives, a Florida federal judge ruled.

Issues for trial include whether exempting the employee from a new patient-care initiative, which required nurse practitioners to provide pregnancy prevention services, would’ve imposed an undue hardship by interfering with the companies’ mission of becoming a primary care-enabled destination and expanding women’s health care, the US District Court for the Southern District of Florida said.
