CVS, Caremark Defeat Mississippi Pharmacy’s Antitrust Claims

CVS and Caremark LLC convinced a federal court to toss claims that the companies conspired to bar a Mississippi pharmacy from Caremark’s pharmacy benefit management network in order to monopolize the state’s prescription medication market.

Mississippi retail pharmacy Rx Solutions failed to properly define the allegedly monopolized market and failed to show the companies engaged in anti-competitive conduct, the US District Court for the Southern District of Mississippi said.
