CVS Biometric Privacy Suit Over ID Photos Sent to State Court

Plaintiffs in a proposed federal class action against CVS Pharmacy Inc. over its alleged collection of biometric information from passport and ID photos must take their claims to state court, a federal district court ruled.

Denise Daichendt and Ada Odell lacked standing to pursue two of their three claims in federal court under the Illinois Biometric Information Privacy Act, Judge Robert W. Gettleman of the US District Court for the Northern District of Illinois said Friday.

Gettleman also granted CVS’s motion to dismiss as to the plaintiffs’ third BIPA claim.
