CVS $3.8 Million Lidocaine Pain Reliever Deal Gets First Nod

CVS Pharmacy Inc. and consumers who alleged the retail chain deceptively marketed lidocaine pain-relief products secured early approval for a settlement providing $3.8 million and label changes.

Magistrate Judge Peggy Kuo of the US District Court for the Eastern District of New York tentatively approved the deal Tuesday.

  • Those who bought affected spray, cream, and patch products in the US after Dec. 11, 2017, are eligible
  • Class members without proof of purchase may recover up to $4.50 per unit, with a three product limit
