CSX Worker’s Time to Sue for Leave Bias Tolled by Class Action

CSX Transportation Inc. must face a lawsuit by a former employee who says he was fired for taking time off under the Family and Medical Leave Act, a Florida federal judge ruled.

The company missed the mark in arguing Nicholas Ingrodi, who sued together with another worker, was too late with his claims because he didn’t sue until more than seven years after CSX’s last alleged violation of his FMLA rights, the US District Court for the Middle District of Florida said.
