CSX Worker Loses Suit Over Mask Dispute That Set Off Tourette’s

CSX Transportation Inc. defeated a discrimination lawsuit by a train conductor with Tourette’s syndrome and claustrophobia who was suspended for six weeks following a confrontation with a supervisor for not wearing a Covid-19 face covering.

The impact the worker’s disability may have had on his reaction to a new CSX zone superintendent’s questiondidn’t require review by a jury, the US District Court for the Middle District of Alabama said.
