CSX Worker Gets Reprisal Trial Over Covid Accommodation Request

A trial is needed to determine if CSX Transportation Inc. retaliated against a diabetic worker by breaking off communication with him after he filed a bias charge over his Covid-19 accommodation request, a judge ruled.

The former train dispatcher, who is now deceased, didn’t learn for three months that his physician and the company’s chief medical officer had worked out an arrangement for his return to work. He was granted access to a dedicated isolated workstation and an infrequently used bathroom. The lack of communication delayed his return, during which he allegedly lost out on at least some wages.
