CSX Worker Gets Bias Trial Over Return-to-Work Exams, Inquiries

A jury must decide whether CSX Transportation Inc. violated disability bias law by subjecting a Nashville rail yard employee to repeated medical examinations and document requests after he was reinstated by a union board.

The railroad says the medical tests and inquiries were required because the former employee’s position as a utility worker was safety sensitive and an initial exam revealed that he had sleep apnea and anxiety, the US District Court for the Middle District of Tennessee said. But a trial under the Americans with Disabilities Act could show CSX regarded him as disabled and the company didn’t establish ...
