A liquidating agent can’t voluntarily dismiss his suit against law firm Polsinelli PC for legal malpractice, a federal judge decided.
The agent wanted to dismiss the case to start another in Missouri after an additional instance of negligence was revealed in discovery and didn’t get included in an expert report. The court on Thursday declined to toss the case, saying the agent’s reasons for seeking dismissal are insufficient to outweigh the prejudice against Polsinelli.
