Bradford-Scott Data LLC must face some claims of a proposed class action alleging it negligently failed to protect the personal information of nearly 42,000 people in a May 2023 data breach.
Lead plaintiffs Anthony Webster and Mark Smith alleged injuries that were sufficiently concrete to establish their standing to sue in federal court and adequately pleaded claims of negligence and negligence per se, Judge Holly A. Brady of the US District Court for the Northern District of Indiana said Thursday.
