Covid-Positive Worker Fired During Quarantine Can Sue for Bias

A certified nursing assistant in Alabama who was fired on her 13th day in Covid-19 quarantine after refusing three times to report to work can pursue her disability discrimination lawsuit, a federal judge ruled.

Lucious Brown tested positive in the early days of the pandemic after feeling severe weakness, a cough, brain fog, and other symptoms, the U.S. District Court for the Middle District of Alabama said. She received her results July 1, 2020, and under then-current Center for Disease Control and Prevention guidelines and her employers’ policy was supposed to self-isolate for 14 days, the court said.
