Court Upholds Denial of Maritime Firm’s Delayed Insurance Claim

A maritime logistics company can’t seek insurance coverage for an embankment-striking incident that led to a property damage lawsuit, since the company failed to timely notify its insurer, a federal appeals court ruled.

A&T Maritime Logistics Inc. “sat on the potential claim and did nothing to prevent the initial damage” caused by the incident from worsening, Judge Jennifer W. Elrod of the US Court of Appeals for the Fifth Circuit wrote in a Tuesday opinion.
