A luxury hair care company can keep some of its trademark claims against a rival skin care brand that is accused of using a similar double-S logo.
But Vicious Brands Inc., which does business as Saints & Sinners, can’t keep pursuing a false advertising claim under the Lanham Act or apply a theory of “reverse confusion"—arguing that a customer could confuse the plaintiffs’ product as the defendants'—to its trademark infringement allegations, the US District Court for the Northern District of California said in a Tuesday order partially granting bids for dismissal and summary judgment.
