Court Revives Suit Over Trucking Applicant’s Criminal History

A Pennsylvania man convinced a federal appeals court to let him pursue a hiring discrimination suit against a trucking company that rejected him because of his criminal history.

Rodney Phath can assert protections under the state’s Criminal History Record Information Act even though Central Transport LLC learned about his robbery conviction without the use of state records, the US Court of Appeals for the Third Circuit said in a Wednesday opinion that reversed the case’s dismissal.
