A federal appeals court on Friday revived a slew of claims from Texas doctors who allege they were underpaid by Blue Cross Blue Shield-affiliated plans.
“Nearly all” the issues before the US Court of Appeals for the Fifth Circuit “require further examination of the evidentiary record,” Judge Stephen Higginson wrote in remanding most of the matters in question back to the US District Court for the Northern District of Texas.
Judges Jerry Smith and Dana Douglas joined in the opinion.
