Coty’s CoverGirl Makeup Product to Face Sun Protection Claims

Coty Inc., the manufacturer of CoverGirl makeup products, will face proposed class action claims alleging that it deceived purchasers about the duration of sun protection in one of its products.

A federal magistrate judge said Monday that Antoinette Meza had plausibly alleged that a reasonable consumer would be deceived by the “24 HR” statement on Coty’s CoverGirl Extreme 3-in-1 Foundation label.

The 24-hour statement and the SPF statement are close to one another and near other label statements such as “Full Coverage,” “SPF 18,” and “Octinoxate Sunscreen,” Magistrate Judge Nathanael Cousins said. It’s reasonable to read the statements together ...
