National law firm Cordell & Cordell will face trial on a paralegal’s claims that she was fired because of her kidney condition and for complaining about an attorney’s sexual harassment.
The US District Court for the District of Kansas decision mostly denying summary judgment in the case turned in part on the men’s divorce and family law-centric firm’s failure to identify who made the termination decision. The lack of an identified decision-maker supports the inference that the stated performance-based reasons were a pretext for retaliation and discrimination, the court said.
