Two Texas police officers aren’t immune from a civil rights suit over whether they used excessive force on a man killed while fleeing arrest, the Fifth Circuit decided.

Darion Baker and a friend stole a car in Los Angeles and were driving through Texas on their way home to Memphis when they were stopped. The parties dispute what happened before Baker was fatally shot.
