Convicted Uber Security Executive Seeks New Precedent in Appeal

A San Francisco federal appeals court judge appeared skeptical at a Tuesday hearing that the court could break from its precedent in overturning the criminal conviction of Uber Technologies Inc.'s Chief Security Officer.

Attorneys for Joseph Sullivan, who was convicted of covering up a 2016 data breach at the rideshare company, argued that the federal trial court failed to properly instruct the jury.

They should have been told that in order to convict on the obstruction charge, prosecutors had to show there was a “nexus” between Sullivan’s actions during the breach and a subsequent investigation by the Federal Trade Commission, ...
