Fandom Inc. must face a proposed class action alleging it shared the video-viewing histories of its subscribers with Facebook in violation of the Video Privacy Protection Act.
Plaintiff Lucinda Jackson plausibly alleged that Fandom, a gaming and entertainment website, was a “video tape service provider” within the meaning of the VPPA, and that her subscription to the website and use of the site made her a “consumer” under the act, Judge Jon S. Tigar of the US District Court for the Northern District of California said Thursday.
