Consumers’ Data Breach Suit Against T-Mobile Sent to Arbitrator

Two customers’ allegations that T-Mobile failed to protect their personal information in a data breach and exposed information allowing their Coinbase cryptocurrency account to be hacked will be heard by an arbitrator.

The arbitration agreement between T-Mobile and plaintiffs Jorge and Marcos Rodriguez clearly delegated threshold questions of arbitrability to the arbitrator, and was neither substantively nor procedurally unconscionable, Judge Anthony J. Battaglia of the US District Court for the Southern District of California said Thursday.

Battalglia also stayed the case as to the plaintiffs’ allegations against Coinbase, pending the Ninth Circuit’s ruling on the company’s motion to compel arbitration ...
