Consumer Dismisses Protein Deception Suit Against Mondelez

A consumer who said Mondelez International Inc. deceptively marketed a lentil snack as “protein-packed” voluntarily dismissed his proposed class action.

Judge Jeffrey S. White, of the US District Court for the Northern District of California, approved the parties’ stipulation of dismissal on Monday. Plaintiff Avi Klammer’s claims were dismissed with prejudice. The claims of “any putative class member” were dismissed without prejudice, and the parties will pay their own attorneys’ fees and costs.
