Florida solar-energy technology provider Suntuity Solar LLC must face a proposed class action alleging it make telemarketing calls to consumers with numbers on the national and Florida do-not-call lists without their consent.
Plaintiff Robin Taylor’s allegations of injury were enough to establish standing to sue in federal court under the Telephone Consumer Protection Act, and she provided enough facts to state claims under the TCPA and the Florida Telephone Solicitation Act, Judge Mary S. Scriven of the US District Court for the Middle District of Florida said Wednesday.
