Consumer Advances Spam Call Class Action Against Quontic Bank

Quontic Bank must face a proposed class action alleging it made telemarketing calls in violation of the Telephone Consumer Protection Act, a federal court ruled.

Paul Sapan had standing to sue Quontic under the TCPA because his allegations that the calls were bothersome, disruptive, and unwanted were sufficient to constitute injury under the act, Judge Cormac J. Carney of the US District Court for the Central District of California said Tuesday.

Carney rejected Quontic’s motion to dismiss.
