Consumer Advances Junk Call Lawsuit Against Magnolia Bank

Magnolia Bank Inc. must face a proposed class action alleging it made marketing calls to consumers for mortgage refinancing services without their consent in violation of the Telephone Consumer Protection Act, a federal court ruled.

Plaintiff Tonia Jewell sufficiently alleged that Magnolia was directly liable for calls made to her by its representative, and vicariously liable for calls made to her by a third-party telemarketing agency she identified as Rasani, Judge Rebecca G. Jennings of the US District Court for the Western District of Kentucky said Thursday.
