Constellation Sues BP Alleging 2021 Winter Storm Contract Breach

BP Energy Co. failed to deliver enough natural gas to Constellation Energy Generation LLC as it attempted to respond to Texas’ Winter Storm Uri in 2021, Constellation claims in a breach-of-contract lawsuit filed Friday.

BP failed to deliver a committed amount of natural gas to Constellation from over one week in February 2021—in the middle of a storm that brought freezing temperatures, snow, and ice to Texas and caused increased demand for natural gas-fueled electric power generation, the complaint says.

Constellation says it incurred more than $1.2 million when it “was forced to seek replacement gas.”
