The Second Circuit upheld the consecutive sentences for two federal robbery-related charges against a defendant Friday.
District courts may impose consecutive sentences, even those exceeding in the aggregate the statute’s maximum punishment, for attempted Hobbs Act robbery and conspiracy to commit Hobbs Act robbery, Judge Pierre N. Leval said for the US Court of Appeals for the Second Circuit. The district court didn’t err here by sentencing Roderick Gunn to consecutive terms of imprisonment, Leval said, affirming the lower court’s order.
