Conagra Can’t Shed ‘100% Whole Fish Fillets’ False-Ad Class Suit

Conagra Brands Inc. failed to convince a federal judge to toss a proposed class action alleging it deceptively labels certain frozen fish products as “100% Whole Fish Fillets.”

The US District Court for the Northern District of Illinois on Wednesday denied ConAgra’s motion to dismiss for most of the plaintiffs’ claims, but cut a claim for injunctive relief.

The consumers alleged Van de Kamp’s and Mrs. Paul’s fish products for battered or breaded fillets are advertised as being made entirely of whole fish fillets though the ingredient list also cites sodium tripolyphosphate as an ingredient. They said the packaging label ...
