Truck-maker Commercial Specialty Truck Holdings LLC must face most claims of a proposed class action alleging it negligently failed to protect the personal information of employees that was exposed in an August 2024 data breach.
Lead plaintiff Rodney Silveira sufficiently alleged concrete injuries sufficient for standing that were traceable to the breach, and adequately pleaded claims of negligence, breach of implied contract, intrusion upon seclusion, and unjust enrichment, Judge Danny C. Reeves of the US District Court for the Eastern District of Kentucky said Tuesday.
