Commerce Department to Redo Wind Energy Company’s Dumping Margin

The US Commerce Department used improper calculations when it determined a Canadian wind turbine importer’s dumping margin and must reexamine the figure, a federal appeals court ruled Tuesday.

The agency used an unreasonable statistical test to justify its methodology when it calculated Marmen Inc.‘s margin, Judge Sharon Prost said in an opinion for the US Court of Appeals for the Federal Circuit. The department also failed to show substantial evidence supporting its rejection of the Quebec-based company’s request for a minor correction to account for an exchange rate in the department’s antidumping probe.
