Colorado Restaurant Workers Get Wage Class Action Certified

Two restaurant servers convinced a federal district court to certify a class action alleging that Perry’s Restaurants Ltd. and Perry’s Steakhouse of Colorado LLC underpaid their workers.

Plaintiffs Anderson Khalid and Lance Green say the defendants paid a subminimum hourly wage in violation of Colorado wage law by forcing servers to contribute a percentage of sales to a tip pool to subsidize other workers. The plaintiffs have alleged common questions that predominate over individual inquiries, Judge William J.
