Dominion Voting Systems Inc. was unable to convince a Delaware judge Thursday that its defamation suit against Newsmax Media Inc. should be adjudicated under New York law.
The second restatement of conflict of laws favors a plaintiff’s principal place of business, Judge Eric M. Davis said in a decision on choice of law. Because Dominion is principally based out of Denver, Colorado, Delaware Superior Court can’t favor Newmax’s place of business in New York, even if most of the allegedly defamatory acts took place there.
