College Hunks Hauling Junk moving service can proceed with its trademark infringement lawsuit against a former franchisee that allegedly used signage from the company after the franchise agreement between them ended, a federal court ruled.
CHHJ Franchising LLC sued the former franchisees, Victor Spaulding and Spaulding Hauling & Moving LLC, in the US District Court for the Middle District of Florida, seeking damages and an injunction against Spaulding’s operations. The moving service alleges that Spaulding ran a competing moving company after the franchise agreement ended and promoted itself with CHHJ’s trademarked “college hunks” sign online and in a storefront.
