Collectors Successfully Challenge ATF’s Biden-Era Gun-Sale Rule

Two Alabama gun collectors convinced a federal court that the US Bureau of Alcohol, Tobacco, Firearms and Explosives exceeded its authority when it adopted a final rule regulating gun sales.

Biden-era gun rules have been under attack since they were adopted. But the US Supreme Court last term upheld a 2022 rule that regulates build-at-home ghost gun kits. The rule subjects the kits to the same regulations as fully assembled firearms.

The high court ruled that ATF had the authority to adopt the rule under the 1968 Gun Control Act.
