Collective Certified in Overtime Lawsuit Against Staffing Firm

A group of employees alleging that an IT staffing firm stiffed them on overtime pay was certified as a collective in their Fair Labor Standards Act lawsuit.

The seven employees of TEKsystems Inc. satisfy the requirements to continue as an FSLA collective and as a class under Federal Rules of Civil Procedure 23(a) and 23(b)(3), Judge William S. Stickman said in a memorandum opinion on Monday. The employees were granted FLSA collective status and class certification in the US District Court for the Western District Pennsylvania.
