Cognizant Can’t Shake Job Bias Class Action After Mistrial

Cognizant Technology Solutions Corp. failed to convince a federal judge to toss a class action after the court declared a mistrial last year due to a deadlocked jury.

The plaintiffs, who were terminated after not having an assignment for five weeks, allege that the multinational IT and consulting company discriminates in favor of South Asian employees, including visa holders. They allege that Cognizant sought a supply of “travel-ready” workers from India ready to be transferred onto US projects, and instructed supervisors to deploy associates with approved visas within six months.
