Claims Trimmed in Class of OneTouchPoint Users’ Data Breach Suit

A class of people suing OneTouchPoint Corp. over a data breach had many of their claims trimmed after a district court ruled they fell short of federal pleading standards.

The class had many of their individual state-based privacy law claims dismissed along with their class-wide requests for declaratory or injunctive relief, Judge Brett H. Ludwig said in his Monday order. The class members also failed to state a claim in their allegations that OneTouchPoint violated various common-laws, breached its fiduciary duty, its third-party beneficiary contract, and its implied contract.
