Civil Rights Appeal Dismissed for Citing ‘Fabricated Cases’

The Ninth Circuit affirmed the dismissal of civil rights claims against the City of Long Beach, Calif., brought by a man over the removal of his daughter during a custody battle with the child’s mother who lived in Georgia, finding his counsel cited “apparently fabricated cases.”

“Because we find that Appellants’ opening brief represents a material failure to comply with our rules, we strike the brief in its entirety pursuant to Ninth Circuit Rule 28–1 and dismiss this appeal,” the US Court of Appeals for the Ninth Circuit said in an opinion by Judge Roopali H. Desai.
