Cigarette Seller Fails to Lift Block on California Deliveries

A cigarette company owned by a federally recognized tribe lost its bid to beat a preliminary injunction stemming from alleged violations of California’s licensing and tax rules.

Azuma Corporation, owned by the Alturas Indian Rancheria, manufactures and sells cigarettes to retailers owned by other Indian tribes, according to an unpublished opinion from the US Court of Appeals for the Ninth Circuit. California placed Azuma on a list of non-compliant businesses under the federal Prevent All Cigarette Trafficking Act because the company didn’t have a state cigarette license or collect or remit state cigarette taxes.
