Chobani LLC largely succeeded in getting a federal judge to dismiss a consumer deception lawsuit alleging the yogurt maker falsely advertised its “Zero Sugar” products because theyactually contained four grams per serving of a monosaccharide called allulose.
The buyers’ claims were preempted by 2020 US Food and Drug Administration guidance that says allulose differs from other monosaccharide sugars, the US District Court for the Northern District of Illinois said Thursday.
