Chipotle Unable to Shake All Claims by Shortchanged Customer

Breach of contract and consumer protection claims against Chipotle Mexican Grill Inc., by a customer who was given insufficient change by the restaurant during the pandemic’s coin shortage, were revived Friday by the Third Circuit.

Chipotle said that James Rice modified the contract when he accepted the food and left without the proper amount of change. But Judge Arianna J. Freeman said in an unpublished opinion for the US Court of Appeals for the Third Circuit that a reasonable jury could find otherwise.
