China Merchants Bank Must Face Discrimination, Retaliation Suit

A former China Merchants Bank Co. department head can pursue her retaliation and discrimination lawsuit because her claims differ from a similar state suit she filed against the bank, a New York federal judge ruled.

China Merchants’ argument failed to convince the federal court that Hui Li’s retaliation claims were based on the same set of facts from an already adjudicated New York state court suit she brought against the bank, said Judge Katherine Polk Failla of the US District Court for the Southern District of New York, denying the bank’s partial motion for dismissal.
