A Delaware district court abused its discretion when it failed to adequately analyze an expert’s testimony in a case alleging child sexual abuse, a federal appeals court said in an opinion.
The district court failed to properly consider the expert’s reliability and fit before admitting his testimony, Judge Paul B. Matey said in a Wednesday opinion. The district court’s error to include the expert’s testimony also may have impacted the jury’s verdict awarding the victim $1.5 million, and the Third Circuit vacated the ruling and remanded the case for a new trial.
