An Ohio restaurant general manager won’t get a trial on claims that Checkers Drive-In Restaurants Inc. fired her because she’s a woman and she complained about sex discrimination.

The US Court of Appeals for the Sixth Circuit said Wednesday that the former employee at a Checkers-owned Rally’s Restaurant lacked evidence warranting the revival of her lawsuit. The ruling illustrates the importance for employers seeking to avoid violating worker rights and related legal liability of conducting thorough workplace investigations, which can trigger the “honest belief” defense.
