Charter’s Arbitration Win in Labor Lawsuit Is Reversed on Appeal

Charter Communications LLC’s success in forcing two employees to arbitrate their labor class action against the telecom giant was overturned by a federal appeals court Friday.

The US Court of Appeals for the Ninth Circuit ruled in an nonprecedential opinion that the claims of one of the employees, Luis Vazquez, were excluded from the company’s arbitration agreement.

The district court must also re-evaluate whether the arbitration agreement for the other employee, Hassan Turner, was substantively unconscionable, the Ninth Circuit said.
